PERSONAL DATA PROTECTION NOTICE AND PATIENT CONSENT

In compliance with Law on Personal Data Protection No. 91/2025/QH15 (effective from 1 January 2026), Family Medical Practice HCMC Joint Stock Venture (“FMP HCMC”) is committed to protecting the privacy, confidentiality, and security of patient’s personal data, including sensitive health-related information.

You confirm that all information You have provided, or will provide, to FMP HCMC in the course of our relationship is lawful, true, accurate, complete, and up to date at the time it is provided.

You understand, agree and consent that the personal data that has been, is and will be provided may be sensitive personal data.

1. Personal Data Collection

In order for FMP HCMC to provide medical services, FMP HCMC may need and require to collect personal data where relevant and lawful, including:

(I) Basic Personal Data includes information that identifies the patient and is necessary for administrative, operational, and service-related purposes, including but not limited to: Full name, date of birth, gender, nationality, passport number or other valid identification, residential address, telephone number and email address, emergency contact details, insurance policy information, appointment and visit records, billing and payment information.

(II) Sensitive Personal Data will be processed strictly for lawful and medical purposes including but not limited to medical records and clinical notes, diagnoses, treatment plans, prescriptions, medical advice, test results, vaccination records, medical history, health history, emergency and ambulance service records.

FMP HCMC may collect these personal data directly or indirectly from Third Party Sources which are necessary to complete the services provided by FMP HCMC, or sources which collection are required or permitted by laws.

FMP HCMC will be, depending on the situation, the (I) controller of the personal data or the (ii) controller and processor of the personal data.

2. Purpose of Data Collection and Processing

By signing this form, or using our medical services, you understand, acknowledge and consent that FMP HCMC will collect, use, store, and process your personal data, including sensitive personal data related to health, for one or more of the following purposes:

➢ Verify the accuracy and completeness of the information you provided verbally, internet or any other form.
➢ Medical consultation, diagnosis, treatment, and follow-up care.
➢ Appointment scheduling and patient administration.
➢ Billing, invoicing, and payment processing.
➢ Insurance eligibility verification, claims submission, and reimbursement.
➢ Compliance with legal, regulatory, medical, and public health obligations.
➢ Internal reporting, quality assurance, and operational management.
➢ Prevent or reduce a threat to life, health, honor, dignity of yourself or others.
➢ For any other purpose required by law, regulation, guideline and/or Competent Authorities.
➢To respond to emergencies.

Only personal data that is necessary, lawful, relevant and proportionate will be collected and retained in accordance with applicable laws.

3. The transfer and disclose of personal data

You explicitly consent and agree that your personal data may be shared and transferred, where necessary and lawful, with:

➢ Any Clinic and/or Department part of the Family Medical Practice Group.
➢ Local and international insurance companies.
➢ Authorized third parties such as laboratories, referral hospitals, IT providers, auditors, and regulators as needed for the purpose of the collection of the data.
➢ Competent authorities where required by Vietnamese law.

4. International Transfer of Personal Data

In order to fulfill the purposes of processing personal data FMP HCMC your be required to provide/share your personal data to a Third Party that may be located in Vietnam or in any other location outside the territory of Vietnam.

When providing/sharing personal data abroad, FMP HCMC will require the third party to ensure that your personal data will be confidential and secure. FMP HCMC will ensure that transfer of personal data is in compliance with Law No. 91/2025/QH15, including appropriate safeguards.

5. Data Protection Measures

FMP HCMC The Company has implemented the necessary security measures to ensure the proper and confidential use of your data, in accordance with Law No. 91/2025/QH15.

6. Rights

Patient have the right to (I) be informed about personal data processing (ii) access and request copies (iii) request correction or updating (iv) withdraw consent where legally permitted (v) request deletion or restriction subject to legal requirements.

The above mentioned rights may be exercised at our registered office in HCM, Hanoi, Da Nang, or Care1.

Withdrawal of, your consent must be done in writing and may affect the ability of FMP HCMC to continue providing services or billing properly.

FMP HCMC will, in its reasonable endeavors, execute a lawful and valid request of your rights. FMP HCMC has the right to invoke any exemptions or exceptions as permitted by law.

THÔNG BÁO BẢO VỆ DỮ LIỆU CÁ NHÂN VÀ ĐỒNG THUẬN CỦA BỆNH NHÂN

Theo Luật Bảo vệ Dữ liệu Cá nhân số 91/2025/QH15 có hiệu lực từ ngày 01 tháng 01 năm 2026, Công ty Cổ phần Phòng khám Gia đình TP. HCM (FMP) cam kết bảo vệ quyền riêng tư, tính bảo mật và an toàn đối với dữ liệu cá nhân của bệnh nhân, bao gồm cả các thông tin sức khỏe nhạy cảm.

Tôi xác nhận rằng tất cả các thông tin tôi cung cấp, đang cung cấp hoặc sẽ cung cấp cho FMP trong suốt quá trình sử dụng dịch vụ là hợp pháp, trung thực, chính xác, đầy đủ và cập nhật tại thời điểm cung cấp.

Tôi hiểu, đồng ý và chấp thuận rằng dữ liệu cá nhân, đang và sẽ được cung cấp có thể bao gồm dữ liệu cá nhân nhạy cảm.

Thu thập dữ liệu cá nhân

FMP có thể cung cấp các dịch vụ y tế, FMP có thể cần thu thập dữ liệu cá nhân một cách hợp pháp và phù hợp, bao gồm nhưng không giới hạn:

I. Dữ liệu cá nhân cơ bản
Bao gồm các thông tin đăng nhập đăng ký bệnh nhân và phục vụ cho mục đích hành chính, vận hành và cung cấp dịch vụ, bao gồm nhưng không giới hạn:

• Họ và tên
• Ngày tháng năm sinh
• Giới tính
• Quốc tịch
• Số hộ chiếu hoặc giấy tờ tùy thân hợp lệ khác
• Địa chỉ cư trú
• Số điện thoại
• Địa chỉ email
• Thông tin người liên hệ khẩn cấp
• Thông tin bảo hiểm
• Hồ sơ tiền sử khám bệnh
• Thông tin thanh toán và hóa đơn

II. Dữ liệu cá nhân nhạy cảm được xử lý nghiêm ngặt cho các mục đích y tế và hợp pháp, bao gồm nhưng không giới hạn:

• Hồ sơ y tế và ghi chú lâm sàng
• Chẩn đoán, kế hoạch điều trị, đơn thuốc, chỉ định y khoa
• Kết quả xét nghiệm
• Hồ sơ tim mạch
• Tình sử bệnh và tình trạng sức khỏe
• Hồ sơ cấp cứu và vận chuyển cấp cứu

FMP có thể thu thập các dữ liệu cá nhân này trực tiếp hoặc gián tiếp từ các bên thứ ba, khi cần thiết hoàn tất dịch vụ y tế hoặc khi việc thu thập được pháp luật cho phép hoặc yêu cầu.
Tùy từng trường hợp, FMP sẽ là:

• I. Bên kiểm soát dữ liệu cá nhân, hoặc
• II. Bên cùng kiểm soát và xử lý dữ liệu cá nhân.

Mục đích thu thập và xử lý dữ liệu

Bằng việc ký vào tài liệu này hoặc sử dụng dịch vụ y tế của chúng tôi, tôi xác nhận và đồng ý rằng FMP TP.HCM sẽ thu thập, sử dụng, lưu trữ và xử lý dữ liệu cá nhân của tôi bao gồm dữ liệu nhạy cảm và sức khỏe cho một hoặc nhiều mục đích sau:

• Xác minh tính chính xác và đầy đủ của thông tin tôi cung cấp bằng liên lạc, trực tuyến hoặc các hình thức khác.
• Tư vấn y tế, chẩn đoán, điều trị và chăm sóc theo dõi.
• Quản lý lịch hẹn và hành chính bệnh nhân.
• Lập hóa đơn, xử lý thanh toán.
• Xác minh quyền lợi bảo hiểm, nộp hồ sơ yêu cầu bồi hoàn và chi trả bảo hiểm.
• Tuyên truyền các nghĩa vụ và pháp lý, quy định, y tế và y tế công cộng.
• Báo cáo nội bộ, đảm bảo chất lượng và quản lý vận hành.
• Phòng ngừa hoặc giảm thiểu các mối đe dọa tính mạng, sức khỏe, danh dự hoặc nhân phẩm của tôi hoặc của người khác.
• Các mục đích khác theo yêu cầu của pháp luật, quy định, hướng dẫn và/hoặc cơ quan có thẩm quyền.
• Đáp ứng với các tình huống khẩn cấp.
• Ngăn ngừa hoặc giảm thiểu mối đe dọa tính mạng, sức khỏe, danh dự, nhân phẩm của bản thân hoặc người khác.

Chỉ những dữ liệu cá nhân cần thiết, hợp pháp, phù hợp và tương xứng mới được thu thập và lưu trữ theo quy định pháp luật hiện hành.

Chia sẻ và tiết lộ dữ liệu cá nhân

Tôi đồng ý rằng dữ liệu cá nhân của tôi có thể được chia sẻ hoặc chuyển giao khi cần thiết và hợp pháp cho:

• Các phòng khám thuộc Tổ hợp Family Medical Practice.
• Các công ty bảo hiểm trong nước và quốc tế.
• Các bên thứ ba có thẩm quyền như phòng xét nghiệm, bệnh viện chuyên tuyến, nhà cung cấp dịch vụ CNTT, kiểm toán viên, cơ quan quản lý khi cần thiết cho mục đích thu thập và xử lý dữ liệu.
• Các cơ quan nhà nước có thẩm quyền theo quy định của pháp luật Việt Nam.

Chuyển dữ liệu cá nhân ra nước ngoài

Thực hiện các mục đích xử lý dữ liệu, FMP có thể cần cung cấp/chia sẻ dữ liệu cá nhân của tôi cho các bên thứ ba tại Việt Nam hoặc bất kỳ địa điểm nào khác ngoài lãnh thổ Việt Nam.
Khi chuyển dữ liệu ra nước ngoài, FMP sẽ yêu cầu bên nhận dữ liệu đảm bảo tính bảo mật và an toàn của dữ liệu cá nhân.
Việc chuyển dữ liệu sẽ tuân thủ Luật số 91/2025/QH15 và các biện pháp bảo vệ phù hợp, bao gồm các điều khoản liên quan trong thỏa thuận giữa các bên.
